2. Scope of Application
These Terms and Conditions apply to all chargeable repair services and warranty repairs carried out by ERC on behalf of manufacturers, distributors, or sellers, unless otherwise agreed in writing.
3. Placing an Order
Repair orders may be placed personally, in writing, or via all commonly used communication methods (e.g. email, online form).
By placing an order, the customer agrees to these Terms and Conditions.
4. Cost Estimates
Cost estimates constitute a service involving labor and are therefore subject to a fee, unless explicitly agreed otherwise.
If additional defects are identified during a repair for which a cost estimate has already been approved, ERC is entitled to prepare a new cost estimate.
If, during troubleshooting or repair, it is determined that:
- the repair is economically unreasonable,
- a cost estimate is rejected by the customer, or
- the repair is technically impossible
(e.g. damaged circuit boards, unavailable spare parts, moisture or overvoltage damage),
ERC is not obligated to restore the device to its original condition.
The customer acknowledges that fault diagnosis requires an effort comparable to an actual repair and includes additional administrative work as well as secure interim storage of the device.
5. Performance of Repairs
Repairs are generally carried out in ERC’s own workshop.
If a repair cannot be performed by ERC, the device may be forwarded, at the customer’s request and at the customer’s expense, to an authorized service partner.
Stated repair timelines are non-binding and may change due to spare part availability or technical circumstances.
6. Payment Terms
Payment is generally due upon collection of the repaired device. If this is not possible, payment may be made by advance payment or bank transfer. The method of payment shall be determined by ERC.
7. Collection and Storage
Upon completion of a repair, the customer will be notified.
The device must be collected within 14 days.
Devices not collected within 3 months will be disposed of in accordance with legal requirements.
Any disposal costs incurred will be charged to the owner of the device.
8. Repair Warranty and Liability
ERC grants a 6‑month warranty on the repair work performed.
This warranty applies exclusively to the actual services rendered.
For installed spare parts, the warranty period granted by the respective manufacturer or supplier to ERC shall apply.
In the event of a justified complaint, the customer’s claim shall be limited to subsequent repair (rectification).
The repair warranty does not apply to defects caused by:
- improper handling, installation, or connection of the device,
- transport damage, overvoltage damage, or moisture damage,
- fogging,
- changes to system settings,
- installation or modification of software,
- damage caused by connecting external components.
ERC accepts no liability for product characteristics as described by the manufacturer in its technical specifications.
If a device is damaged by ERC during repair, ERC will repair the damage free of charge.
If repair is not possible or economically unreasonable, the current market value of the device will be reimbursed.
ERC assumes no liability for data loss.
It is the sole responsibility of the customer to back up and secure all data prior to handing over the device.
9. Data Protection
Personal data is processed exclusively for the purpose of handling the repair order.
In the case of warranty repairs, personal data may be forwarded to the manufacturer upon request if required to fulfill warranty obligations.

10. Jurisdiction and Final Provisions
To the extent permitted by law, the place of jurisdiction shall be Trier, Germany.
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
